Tesco Diwali - Terms and Conditions

Entry instructions are deemed to form part of the terms and conditions and by entering this promotion, the participants will be deemed to have read and understood these Terms and Conditions and be bound by them. Please retain a copy for your information.

Eligibility:

  1. The Promotion is organised by Tilda Ltd, Coldharbour Lane, Rainham, Essex, RM13 9YQ
  2. The Promotion is open to all UK residents, aged 18+ years, excluding employees of the Promoter or their immediate families, its associated agents or anyone else professionally associated with the administration of the Promotion.
  3. Purchase is not necessary. Internet access, a valid email address and phone number are required.

 

Promotional Period:

  • Enter between 00:01 BST on 15th September 2023 and 23:59 BST on 30th November 2023 (the ‘Promotional Period’) Any entries received outside the Promotional Period will not be accepted.

How to Enter:

  1. Scan the QR code on promotional packs or on promotional marketing in selected Tesco stores or go online tovisit https://www.tilda.com/tesco-diwali-competition/ during the promotional period to enter Prize draws.
  2. Enter your full name and email address to enter into the weekly Prize draws (Friday – Thursday).
  3. Winners will be randomly selected each Monday during the Promotional Period and notified within 2 days of each draw date via an email sent to the email address provided on entry form from win@tilda.com
  4. To claim a Prize, respond to the winning notification confirming full name, full home address, phone number within 14 days of first notification. In the case that they do not respond in time, reject their Prize or are ineligible, another winner will be selected using the same methodology as above. The process will repeat twice for each weekly Prize after which any remaining Prizes will be null and void. Entrants are encouraged to monitor their email account during this time in case they are a winner.
  5. All entries that did not win will be automatically entered into the Prize draw for the following week.
  6. Entries are limited to a maximum of one entry per person
  7. Prizes are limited to a maximum of one Prize per household
  8. A person is defined by name, address, phone number and email address and the combination needs to be unique to a single participant for a Prize claim to be valid. Postal addresses used to claim may be checked and verified via Royal Mail PAF for eligibility. Winners are provisional at point of win/claim and may be subject to Prize claim verification to qualify win.
  9. Entries (bulk or otherwise) made from trade, syndicates, consumer groups or third parties will not be accepted. If it becomes apparent that a participant is reposting the same content multiple times or using a computer(s) to circumvent this or any other condition by, for example, the use of ‘script’, ‘brute force’, multiple identities or addresses or any other automated means, that person’s entries will be disqualified and any Prize award will be void.

    Promotion Winner Selection

  11. Winners will be drawn at random by a computer process that produces independently verifiable results from the database of all valid entries. If multiple winners are selected from the same household, only the first entry will be accepted and all other Prizes will be redrawn.
  12. The Prize draws for the weekly promotional periods will take place on the following dates:

    • Prizes will be delivered within 28 days of weekly winner selection, valid claim and the completion of any verification process.

    General:

  14. The Prizes are not transferable or exchangeable and cannot be redeemed for monetary value or for any other form of compensation. If for any reason any element of a Prize is not available, the Promoter reserves the right, at its sole discretion to substitute another Prize for it, of equal or greater value.
  15. The Promoter cannot be held responsible for entries or claims that fail to register, are delayed, invalid, misdirected or incomplete, or indeed for network, computer hardware or software failures of any kind, which may restrict or delay entry.
  16. Entry must be made directly by the individual entering the Promotion. Incomplete or illegible entries together with entries which do not satisfy the requirements of these Terms & Conditions in full will be disqualified and will not be considered.
  17. In the event that the Promotion is not capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right to disqualify any individual who tampers with the entry process or does not comply with these Terms & Conditions and to cancel, modify or suspend the Promotion or invalidate any affected entries.
  18. The Promoter will make available a list of winners’ surnames and counties of residence to members of the public or regulators who request such details within 3 months of the closing date of this promotion. Entrants can object to disclosure, or request that disclosure be limited in scope by contacting win@tilda.com We may nevertheless disclose the information to the Advertising Standards Authority if required to do so. You may request a copy of the winners list by emailing win@tilda.com. The Promoter reserves the right to refuse such requests.
  19. The Promoter seeks to run fair and secure promotions and prevent abuse and cheating. If you enter in a way that is not consistent with these Terms & Conditions, your entry, or entries (and any of your associated aliases) will be disqualified, any Prize awarded may be void and recoverable. The Promoter reserves the right to verify the eligibility of participants and/or provisional winners by requesting such information that it considers reasonably necessary for this purpose including proof of address and ID (passport, driving licence or equivalent). A Prize may be withheld unless and until verification is completed satisfactorily.
  20. It is the responsibility of the entrant to provide correct, up-to-date details when entering the promotion and on Prize acceptance. The Promoter cannot be held responsible for winners failing to supply accurate information which affects Prize acceptance or delivery of their

The Promoter will not be liable for any failure to comply with its obligations or any delay in performing its obligations within these terms and conditions if an act, omission, event or circumstance occurs caused by (but not limited to) global or regional health crises, weather conditions, fire, flood, strike, hurricane, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, epidemic, pandemic, famine, plague or other natural calamities and acts of God, or any other circumstances beyond the reasonable control of the Promoter.
  22. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion, the fulfilment of the Prizes and/or the use of the Prizes, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
  23. The Promoter has no control over internet or communication networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter will not be held liable to any individual for any fraud committed by any third party nor for any event beyond its control including, but not limited to, user error and any network, computer, hardware or software failures of any kind which may restrict, delay or prevent a participant’s entry to the promotion.
  24. The Promoter may refuse to award a Prize in the event of any entrant’s fraud, dishonesty, breach or non-entitlement under these Terms & Conditions or seek recovery of its value if the Prize has been awarded. Any and all personal data supplied for the running of this Promotion will be used solely for the purpose of this Promotion by the Promoter and will not be disclosed to a third party or used for any other purpose unless your positive consent has been obtained. If you didn’t opt into the Tilda Newsletter your personal data will be deleted by 29/02/24. All personal data will be handled in accordance with current Data Protection legislation and the Promoter’s privacy policy, available at https://www.tilda.com/privacy-policy/. You can request access to your personal data, or have any inaccuracies rectified, by sending an email to win@tilda.com. By participating in the promotion, you agree to the use of your personal data as described here.
  25. The Promoter’s decision is final and binding in all circumstances in relation to the Promotion.
  26. If any provisions of these Terms & Conditions are judged to be invalid, illegal, or unenforceable, this will not affect or impact the continuation in full force and effect of the remainder of the provisions.
  27. In the event of a discrepancy between these Terms & Conditions and the details in any promotional material, the details in the Terms & Conditions will prevail.
  28. These Terms & Conditions are governed by English law and their interpretation and application will be subject to the exclusive jurisdiction of the courts of England and Wales unless you live in another part of the UK, in which case your local courts will have jurisdiction.Tilda Limited.
